1. Nature of Our Service

Sama Matrimony is a matrimonial consulting and matchmaking company. We introduce prospective matches based on the information and preferences shared with us. We are an introduction service only. We do not guarantee that any introduction will result in a match, engagement, or marriage.

2. Eligibility

You must be at least 18 years old (women) or 21 years old (men), legally competent to marry under applicable Indian law, and not currently married (unless legally divorced or widowed). Members must provide accurate and truthful information.

3. Registration and Accuracy of Information

Members are solely responsible for the accuracy, completeness, and truthfulness of all details, documents, and photographs they provide. Providing false or misleading information may result in immediate removal of the profile without refund.

4. Our Verification Process

We take reasonable care to review profiles and documents submitted to us and accept only profiles that appear genuine on the basis of that review. However:

• Our verification is limited to the information, documents, and checks we are reasonably able to carry out.
• We do not guarantee the complete accuracy, authenticity, or current status of any member's details, including age, marital status, education, income, employment, family background, health, character, or past history.
• Verification by us is not a certificate, warranty, or guarantee about any person.

5. Member's Own Responsibility and Due Diligence

Marriage is a serious personal and legal decision. Every Member (and their family) must independently verify the other party before proceeding, including background, identity, employment, finances, health, marital history, and family details, through their own enquiries and, where needed, professional or legal help. Any meeting, communication, financial dealing, or decision taken between Members is entirely at their own risk and responsibility.

6. Limitation of Liability

To the fullest extent permitted by law:

• Sama Matrimony is not responsible or liable for any misrepresentation, fraud, cheating, impersonation, concealment of facts, or wrong information by any Member or third party.
• We are not liable for any loss, damage, expense, emotional distress, or dispute, direct or indirect, arising from any introduction, meeting, relationship, engagement, marriage, or break-up.
• We are not a party to any relationship, agreement, or dealing between Members.
• Our total liability, if any, shall in no event exceed the fees actually paid by the Member to us.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

7. Fees and No-Refund Policy

All fees paid to Sama Matrimony are non-refundable, including where no suitable match is found, the Member changes their mind, finds a match elsewhere, is dissatisfied with a match, or the profile is removed for violating these Terms. Fees cover our time, effort, and services, not a particular result. By paying, you confirm that you have read and accepted this policy. Fees, once paid, are also non-transferable.

8. Member Conduct

Members agree not to: submit false information or photographs; harass, abuse, or threaten any person; use the service for any commercial, unlawful, or non-matrimonial purpose; ask for or share money in a manner that amounts to fraud; or share another Member's details with third parties without consent. We may suspend or terminate any profile at our sole discretion, without refund, for violation of these Terms.

9. Confidentiality of Profiles

Profile details shared with a Member are for matrimonial purposes only. Members must keep them confidential and not misuse them.

10. Indemnity

The Member agrees to indemnify and hold harmless Sama Matrimony, its owners, partners, employees, and associates from any claim, loss, or legal action arising from the Member's false information, misconduct, breach of these Terms, or dealings with any other Member.

11. Right to Refuse or Terminate

We may accept, reject, suspend, or remove any profile or membership at any time at our discretion.

12. Intellectual Property

All website content, logos, and materials belong to Sama Matrimony and may not be copied or used without written permission.

13. Changes to Terms

We may update these Terms from time to time. Continued use of our services means you accept the updated Terms.

14. Governing Law, Arbitration and Jurisdiction

These Terms are governed by the laws of India. Any dispute shall first be attempted to be resolved amicably. Failing that, it shall be referred to a sole arbitrator appointed by the Company under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Gurgaon, and the language shall be English. Subject to this, the courts at Gurgaon, Haryana shall have exclusive jurisdiction.
